Art Commission Terms and Conditions Agreement
This document will go over the terms and conditions of receiving an art commission by Runaway Goldfish through The Fishbowl Arts and Entertainment LLC. The intention of the agreement is to protect both the artist and the client to make sure that both parties have a complete understanding on the expectations from when the idea is formed to the final render of the commission. General

Prices are subject to change based on demand.

I have the right to reject any order for any reason.

On average, the time it takes to finish your commission will take two weeks but may vary depending on factors such as health, the complexity of the commissioned piece, other work, and art show schedules.

For more complex pieces that take longer than two weeks may be subject to additional fees.

Payment
-
I currently only accept USD.

Invoices can be paid directly or you can send money through Paypal or Cash App.

All commissions require a minimum 50% deposit.

Deposits are non-refundable.

Do not send me any payment before I have sent an invoice and agreed to give you a slot.

Consultations
-
A scheduled consultation session is required for any commissions that may need more than 30 minutes of consulting.

For custom work that requires more than 30 minutes of consulting, there is a minimum deposit which includes a one hour consultation. For any additional consulting, you will be charged for every additional hour. Please be sure to have as much information available to you prior to our meeting.

Types of consultations that are available: illustration, graphic design and animation.

Illustration consultations include topics such as story projects, character design, coloring/inking

Graphic design consultations include logos, graphic art, web design, tattoo designs and typography

Animation commissions may also include any visual development (character design, backgrounds, animatics, etc). Rates can vary depending on the needs of the commission (visual development vs. animation) with animation typically being charged per frame.

Multiple consultation appointments may be required for check ins or edits depending on the size and complexity of the project.

Sketches
-
When the client is in the sketch phase of their commission, the pricing for both traditional art and digital art commissions include any research needed to complete the design and three edits/corrections.

For traditional art pieces, no additional edits or corrections can be made after the three corrections have been made in the sketch phase.

Color/Line work

Color and line work may be charged separately depending upon the complexity of the commission.

Traditional art
-
Any art using non-digital, traditional art mediums will be charged a materials fee. The materials fee may vary depending on the project.

Digital art
-
Any digital art commissions will not include a fee for materials but will still follow the same terms for consultations, sketch work and color/line work.

For any digital art, a total of 6 edits will be allowed per piece: 3 edits during the sketch phase and 3 edits during the coloring/line work phase. After all edits have been used, any edits are final.

If the client would like to continue modifying their work after they had used all editing opportunities, they will be subjected to additional fees.

Finished work

All work produced (including custom work) is owned by me and may be used at my own will for promotion or profit unless other terms were discussed prior to the start of the commission.

I will NOT claim the intellectual property (IP) of the commissioned artwork.

I will NOT profit beyond the mutually agreed terms from the commissioned artwork unless you (the customer) break any of them.

I reserve the right to post the commissioned artwork online, in my portfolio as well as in publications such as art books.

Before a piece will be considered finished, the client must go through the artist pipeline which includes a sketch phase and the color/line work phase. Consultation may be required depending upon the complexity of the piece.

You may request full ownership of the work if the artist agrees to release ownership.

If the artist chooses to release ownership, the client may be subjected to a fee (which will be discussed between the client and artist) and be sent an original digital file and/or the original piece. After the fee has been paid, the file and/or original piece will be sent to the client, archived for 30 days after the file and/or original piece was sent, then deleted after the 30 days. After the piece has been deleted, the new owner can use the piece however they see fit.

Use of Art/Resale/Reprint

Commissioned art can be used only for agreed upon use. Art cannot be commercially resold, repurposed or reprinted unless those terms had been discussed and agreed upon by both parties prior to the commission being finished or if there was a transfer of ownership of the original artwork.

I retain all copyrights over the commissioned artwork.

Cancellation and Refund policy

I reserve the right to cancel and refund the order at any time for any reason.

A client may back out of a commission any time but deposits are non-refundable.

Upon cancellation, the client cannot use any of the artwork produced commercially, claim the artwork as your own, or alter the artwork without my consent.

What do you get?
-
Drafts/mockups where you must decide and give input on. Any additional mock ups needed for each commission may require additional fees.

Rough sketches and/or final sketches that you must accept before I continue the work

Insight and involvement throughout the making of your commission.

Full-resolution file and the original finished commission.
